Introduction<\/strong><\/h4>\n<p data-start=\"288\" data-end=\"621\">These Terms of Service (hereinafter referred to as the \u201c<strong>Terms<\/strong>\u201d) govern the use of the website <a class=\"decorated-link\" href=\"https:\/\/1auto.ee\" target=\"_blank\" rel=\"noopener\" data-start=\"382\" data-end=\"398\">https:\/\/1auto.ee<\/a> and all of its subpages (hereinafter referred to as the \u201c<strong>Website\u201d<\/strong>).<br data-start=\"466\" data-end=\"469\" \/>The Website is operated by MARBELAUTO O\u00dc, registration code 17312034, Republic of Estonia (hereinafter referred to as the \u201c<strong>Service Provider<\/strong>\u201d).<\/p>\n<p data-start=\"623\" data-end=\"867\">By using the Website (including creating an account, publishing listings, browsing, or using other services), you confirm that you have read and agree to these Terms.<br data-start=\"789\" data-end=\"792\" \/>If you do not agree to the Terms, you are not permitted to use the Website.<\/p>\n<h4 data-start=\"874\" data-end=\"897\"><strong data-start=\"879\" data-end=\"897\">2. Definitions<\/strong><\/h4>\n<p data-start=\"899\" data-end=\"1347\"><strong data-start=\"899\" data-end=\"912\">2.1. User<\/strong> \u2013 a natural person (consumer) or a legal entity (business client) and their authorized representatives who use the Website.<br data-start=\"1036\" data-end=\"1039\" \/><strong data-start=\"1039\" data-end=\"1055\">2.2. Listing<\/strong> \u2013 an announcement published on the Website by a Business Client offering a vehicle for sale, exchange, or promotion.<br data-start=\"1172\" data-end=\"1175\" \/><strong data-start=\"1175\" data-end=\"1191\">2.3. Content<\/strong> \u2013 all texts, photos, videos, logos, and data uploaded by the User.<br data-start=\"1258\" data-end=\"1261\" \/><strong data-start=\"1261\" data-end=\"1287\">2.4. Packages\/Services<\/strong> \u2013 free or paid features provided by the Service Provider.<\/p>\n<h4 data-start=\"1354\" data-end=\"1373\"><strong data-start=\"1359\" data-end=\"1373\">3. Service<\/strong><\/h4>\n<p data-start=\"1375\" data-end=\"1546\"><strong data-start=\"1375\" data-end=\"1406\">3.1. Nature of the Service.<\/strong> The Service Provider offers a platform for publishing vehicle sales listings, tracking statistics, browsing listings, and comparing them.<\/p>\n<p data-start=\"1548\" data-end=\"1816\"><strong data-start=\"1548\" data-end=\"1571\">3.2. Paid Services.<\/strong> Paid packages and additional services are intended for business clients (B2B) and may only be used on behalf of a legal entity.<br data-start=\"1699\" data-end=\"1702\" \/>Natural persons may only access free features (including browsing, comparing listings, and adding to favorites).<\/p>\n<p data-start=\"1818\" data-end=\"2095\"><strong data-start=\"1818\" data-end=\"1854\">3.3. Account and Representation.<\/strong><br data-start=\"1854\" data-end=\"1857\" \/>When creating an account, the User must provide accurate and complete information.<br data-start=\"1939\" data-end=\"1942\" \/>A Business Client confirms that they are acting with the proper authorization.<br data-start=\"2020\" data-end=\"2023\" \/>The User is responsible for all actions performed under their account.<\/p>\n<p data-start=\"2097\" data-end=\"2348\"><strong data-start=\"2097\" data-end=\"2119\">3.4. Transactions.<\/strong><br data-start=\"2119\" data-end=\"2122\" \/>All transactions (sale, purchase, exchange, etc.) take place directly between Users outside the Website.<br data-start=\"2226\" data-end=\"2229\" \/>The Service Provider is not a party to any transaction and bears no responsibility for the performance of agreements.<\/p>\n<p data-start=\"2350\" data-end=\"2704\"><strong data-start=\"2350\" data-end=\"2397\">3.5. Service Modifications and Maintenance.<\/strong><br data-start=\"2397\" data-end=\"2400\" \/>The Service Provider may improve, modify, or suspend core functionalities of the service.<br data-start=\"2489\" data-end=\"2492\" \/>Users will be reasonably notified of any material changes.<br data-start=\"2550\" data-end=\"2553\" \/>During scheduled maintenance, the service may be temporarily unavailable.<br data-start=\"2626\" data-end=\"2629\" \/>Secondary functionalities may be changed or removed without prior notice.<\/p>\n<h4 data-start=\"2711\" data-end=\"2743\"><strong data-start=\"2716\" data-end=\"2743\">4. Listing Requirements<\/strong><\/h4>\n<p data-start=\"2745\" data-end=\"2862\"><strong data-start=\"2745\" data-end=\"2753\">4.1.<\/strong> The User is responsible for ensuring that all information provided in listings is accurate and up to date.<\/p>\n<p data-start=\"2864\" data-end=\"3033\"><strong data-start=\"2864\" data-end=\"2872\">4.2.<\/strong> Listings must be clear, precise, and descriptive of the offered object. Misleading links, advertisements, or references to competitor websites are prohibited.<\/p>\n<p data-start=\"3035\" data-end=\"3091\"><strong data-start=\"3035\" data-end=\"3043\">4.3.<\/strong> Only one listing may be published per object.<\/p>\n<p data-start=\"3093\" data-end=\"3263\"><strong data-start=\"3093\" data-end=\"3101\">4.4.<\/strong> Images, videos, and other files attached to a listing must not contain third-party watermarks and must belong to the User or be used with proper authorization.<\/p>\n<p data-start=\"3265\" data-end=\"3414\"><strong data-start=\"3265\" data-end=\"3273\">4.5.<\/strong> The Service Provider reserves the right to remove or suspend any listings that do not comply with these requirements without prior notice.<\/p>\n<p data-start=\"3416\" data-end=\"3505\"><strong data-start=\"3416\" data-end=\"3424\">4.6.<\/strong> Offensive, discriminatory, illegal, or obscene content is strictly prohibited.<\/p>\n<p data-start=\"3507\" data-end=\"3616\"><strong data-start=\"3507\" data-end=\"3515\">4.7.<\/strong> Intellectual property infringement (e.g., copying another user\u2019s listings or photos) is forbidden.<\/p>\n<p data-start=\"3618\" data-end=\"3687\"><strong data-start=\"3618\" data-end=\"3659\">4.8. <\/strong>Accuracy of Vehicle Information. The User confirms that:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li data-start=\"3690\" data-end=\"3791\">the VIN, mileage, and other data stated in the listing are accurate to the best of their knowledge;<\/li>\n<li data-start=\"3690\" data-end=\"3791\">any major accident, damage, or repair history is disclosed;<\/li>\n<li data-start=\"3858\" data-end=\"3983\">the vehicle is not stolen or legally encumbered (leasing, pledge, seizure) or that such encumbrances are clearly disclosed;<\/li>\n<li data-start=\"3858\" data-end=\"3983\">the images, videos, and other files in the listing reflect the actual vehicle being offered.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h4 data-start=\"4087\" data-end=\"4126\"><strong data-start=\"4092\" data-end=\"4126\">5. User Rights and Obligations<\/strong><\/h4>\n<p data-start=\"4128\" data-end=\"4390\"><strong data-start=\"4128\" data-end=\"4136\">5.1.<\/strong> Accurate and complete data must be provided when creating an account.<br data-start=\"4206\" data-end=\"4209\" \/><strong data-start=\"4209\" data-end=\"4217\">5.2.<\/strong> The User is responsible for the security of their account and login credentials.<br data-start=\"4298\" data-end=\"4301\" \/><strong data-start=\"4301\" data-end=\"4309\">5.3.<\/strong> Listings may only be published for objects the User has a legal right to sell.<\/p>\n<p data-start=\"4392\" data-end=\"4535\"><strong data-start=\"4392\" data-end=\"4400\">5.4.<\/strong> The User is prohibited from using the Website in a manner that violates applicable laws or disrupts its normal operation, including:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li data-start=\"4538\" data-end=\"4593\">distributing malware, viruses, or other harmful code;<\/li>\n<li data-start=\"4538\" data-end=\"4593\">collecting or processing data (including information about other users) without consent;<\/li>\n<li data-start=\"4538\" data-end=\"4593\">using automated queries, bots, scripts, or scraping tools;<\/li>\n<li data-start=\"4538\" data-end=\"4593\">bypassing or attempting to circumvent security measures or reverse-engineering the platform;<\/li>\n<li data-start=\"4538\" data-end=\"4593\">creating or distributing spam listings or other unwanted content;<\/li>\n<li data-start=\"4538\" data-end=\"4593\">overloading the system or otherwise disrupting the Website\u2019s normal functioning.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p data-start=\"5003\" data-end=\"5143\"><strong data-start=\"5003\" data-end=\"5011\">5.5.<\/strong> The User is liable for their actions and must compensate the Service Provider for any damages arising from a breach of the Terms.<\/p>\n<p data-start=\"5145\" data-end=\"5241\"><strong data-start=\"5145\" data-end=\"5153\">5.6.<\/strong> The User must pay for all paid services according to the <span style=\"text-decoration: underline;\"><a href=\"https:\/\/1auto.ee\/en\/packages\/\" target=\"_blank\" rel=\"noopener\">price list<\/a><\/span> and agreed terms.<\/p>\n<h4 data-start=\"5248\" data-end=\"5286\"><strong data-start=\"5253\" data-end=\"5286\">6. Fees, Billing, and Refunds<\/strong><\/h4>\n<p data-start=\"5288\" data-end=\"6240\"><strong data-start=\"5288\" data-end=\"5296\">6.1.<\/strong> Publishing listings and using certain additional services is subject to a fee, available only to business clients, according to the <a href=\"https:\/\/1auto.ee\/en\/packages\/\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;\">price list<\/span><\/a>.<br data-start=\"5411\" data-end=\"5414\" \/><strong data-start=\"5414\" data-end=\"5422\">6.2.<\/strong> Payments for services are made via secure payment methods (invoice, bank transfer, etc.).<br data-start=\"5512\" data-end=\"5515\" \/><strong data-start=\"5515\" data-end=\"5523\">6.3.<\/strong> Packages are prepaid monthly or annually and renew automatically unless the User notifies the Service Provider of termination.<br data-start=\"5650\" data-end=\"5653\" \/><strong data-start=\"5653\" data-end=\"5661\">6.4.<\/strong> Cancellations take effect at the end of the current period; payments already made are non-refundable unless otherwise agreed.<br data-start=\"5787\" data-end=\"5790\" \/><strong data-start=\"5790\" data-end=\"5798\">6.5.<\/strong> The Service Provider may amend the <a href=\"https:\/\/1auto.ee\/en\/packages\/\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;\">price list<\/span><\/a> by notifying the User at least 30 calendar days prior to the effective date.<br data-start=\"5921\" data-end=\"5924\" \/><strong data-start=\"5924\" data-end=\"5932\">6.6.<\/strong> Statutory interest and possible collection or court costs apply to overdue payments.<br data-start=\"6017\" data-end=\"6020\" \/><strong data-start=\"6020\" data-end=\"6028\">6.7.<\/strong> Services are digital and available for immediate use; payments are non-refundable except when the Service was unavailable due to the Service Provider\u2019s fault, in which case proportional credit will be granted.<\/p>\n<h4 data-start=\"6247\" data-end=\"6295\"><strong data-start=\"6252\" data-end=\"6295\">7. Intellectual Property and Data Usage<\/strong><\/h4>\n<p data-start=\"6297\" data-end=\"7025\"><strong data-start=\"6297\" data-end=\"6305\">7.1.<\/strong> All design elements, software, trademarks, databases, and content of the Website are owned by MARBELAUTO O\u00dc or its partners.<br data-start=\"6430\" data-end=\"6433\" \/><strong data-start=\"6433\" data-end=\"6441\">7.2.<\/strong> The User may not copy, distribute, sell, lease, reprogram, or translate any Website content into other languages without written permission.<br data-start=\"6582\" data-end=\"6585\" \/><strong data-start=\"6585\" data-end=\"6593\">7.3.<\/strong> By submitting a listing, the User grants the Service Provider a worldwide, non-exclusive, royalty-free, sublicensable, and transferable simple license to use the listing and related data (including images, texts, and technical specifications) for service delivery, promotion, and creation of anonymized statistics.<br data-start=\"6908\" data-end=\"6911\" \/><strong data-start=\"6911\" data-end=\"6919\">7.4.<\/strong> The license remains valid while the listing is active and for a reasonable archiving period thereafter.<\/p>\n<h4 data-start=\"7032\" data-end=\"7068\"><strong data-start=\"7037\" data-end=\"7068\">8. Liability and Warranties<\/strong><\/h4>\n<p data-start=\"7070\" data-end=\"7806\"><strong data-start=\"7070\" data-end=\"7078\">8.1.<\/strong> The service is provided on an \u201cas-is\u201d basis.<br data-start=\"7123\" data-end=\"7126\" \/><strong data-start=\"7126\" data-end=\"7134\">8.2.<\/strong> The Service Provider does not guarantee uninterrupted or error-free operation.<br data-start=\"7213\" data-end=\"7216\" \/><strong data-start=\"7216\" data-end=\"7224\">8.3.<\/strong> The Service Provider is not responsible for the content of listings, quality, or legality of the offered vehicles.<br data-start=\"7339\" data-end=\"7342\" \/><strong data-start=\"7342\" data-end=\"7350\">8.4.<\/strong> The Service Provider is not liable for technical failures, viruses, data loss, or actions of third parties.<br data-start=\"7458\" data-end=\"7461\" \/><strong data-start=\"7461\" data-end=\"7469\">8.5.<\/strong> The User is liable for damages resulting from violation of the Terms.<br data-start=\"7539\" data-end=\"7542\" \/><strong data-start=\"7542\" data-end=\"7550\">8.6.<\/strong> The Service Provider\u2019s total liability shall not exceed the amount paid by the User during the three (3) months preceding the claim.<br data-start=\"7683\" data-end=\"7686\" \/><strong data-start=\"7686\" data-end=\"7694\">8.7.<\/strong> The Service Provider shall not be liable for indirect damages, lost profits, reputational harm, or data loss.<\/p>\n<h4 data-start=\"7813\" data-end=\"7849\"><strong data-start=\"7818\" data-end=\"7849\">9. Validity and Termination<\/strong><\/h4>\n<p data-start=\"7851\" data-end=\"8489\"><strong data-start=\"7851\" data-end=\"7859\">9.1.<\/strong> These Terms are valid indefinitely.<br data-start=\"7895\" data-end=\"7898\" \/><strong data-start=\"7898\" data-end=\"7906\">9.2.<\/strong> The Service Provider may suspend or terminate a User\u2019s account in case of breach of the Terms or payment default.<br data-start=\"8020\" data-end=\"8023\" \/><strong data-start=\"8023\" data-end=\"8031\">9.3.<\/strong> The User may close their account at any time; paid fees are non-refundable.<br data-start=\"8107\" data-end=\"8110\" \/><strong data-start=\"8110\" data-end=\"8118\">9.4.<\/strong> The Service Provider may amend the Terms at any time by publishing the new version on the Website.<br data-start=\"8217\" data-end=\"8220\" \/><strong data-start=\"8220\" data-end=\"8228\">9.5.<\/strong> The Service Provider may terminate the service for technical, legal, or business reasons.<br data-start=\"8318\" data-end=\"8321\" \/><strong data-start=\"8321\" data-end=\"8329\">9.6.<\/strong> Neither party shall be liable for non-performance caused by force majeure (e.g., major communication or power outages, natural disasters, acts of war, etc.).<\/p>\n<h4 data-start=\"8496\" data-end=\"8536\"><strong data-start=\"8501\" data-end=\"8536\">10. Data Protection and Privacy<\/strong><\/h4>\n<p data-start=\"8538\" data-end=\"8965\"><strong data-start=\"8538\" data-end=\"8547\">10.1.<\/strong> Personal data is processed in accordance with the <a href=\"https:\/\/1auto.ee\/en\/privacy-policy\/\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;\"><strong data-start=\"8598\" data-end=\"8616\">Privacy Policy<\/strong><\/span><\/a> and <a href=\"https:\/\/1auto.ee\/en\/cookie-policy\/\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;\"><strong data-start=\"8621\" data-end=\"8638\">Cookie Policy<\/strong><\/span><\/a>.<br data-start=\"8639\" data-end=\"8642\" \/><strong data-start=\"8642\" data-end=\"8651\">10.2.<\/strong> MARBELAUTO O\u00dc processes data in compliance with applicable laws, ensuring data security and confidentiality.<br data-start=\"8760\" data-end=\"8763\" \/><strong data-start=\"8763\" data-end=\"8772\">10.3.<\/strong> System logs are retained for a reasonable period for security and auditing purposes.<br data-start=\"8857\" data-end=\"8860\" \/><strong data-start=\"8860\" data-end=\"8869\">10.4.<\/strong> The User has the right to access, correct, or delete their personal data as permitted by law.<\/p>\n<h4 data-start=\"8972\" data-end=\"9018\"><strong data-start=\"8977\" data-end=\"9018\">11. Complaints and Dispute Resolution<\/strong><\/h4>\n<p data-start=\"9020\" data-end=\"9686\"><strong data-start=\"9020\" data-end=\"9029\">11.1.<\/strong> Complaints may be submitted via the <a href=\"https:\/\/1auto.ee\/en\/contact\/\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;\">contact form<\/span><\/a>. The Service Provider will respond as soon as possible, no later than within five (5) business days.<br data-start=\"9212\" data-end=\"9215\" \/><strong data-start=\"9215\" data-end=\"9224\">11.2.<\/strong> Disputes shall be resolved primarily through negotiations.<br data-start=\"9283\" data-end=\"9286\" \/><strong data-start=\"9286\" data-end=\"9295\">11.3.<\/strong> If no agreement is reached, disputes shall be settled in the Tartu County Court, Republic of Estonia, under Estonian law.<br data-start=\"9421\" data-end=\"9424\" \/><strong data-start=\"9424\" data-end=\"9433\">11.4.<\/strong> If the User is a natural person and the dispute concerns free services, the User may use legal remedies provided by law (including contacting the Consumer Disputes Committee).<br data-start=\"9613\" data-end=\"9616\" \/>Paid services are B2B, and consumer dispute procedures do not apply.<\/p>\n<h4 data-start=\"9693\" data-end=\"9721\"><strong data-start=\"9698\" data-end=\"9721\">12. Indemnification<\/strong><\/h4>\n<p data-start=\"9723\" data-end=\"9920\">The User shall indemnify the Service Provider against all claims, damages, and costs (including reasonable legal fees) arising from the User\u2019s actions, uploaded content, or breach of these Terms.<\/p>\n<h4 data-start=\"9927\" data-end=\"9978\"><strong data-start=\"9932\" data-end=\"9978\">13. Third-Party Data Sources and API Usage<\/strong><\/h4>\n<p data-start=\"9980\" data-end=\"10282\">The Service Provider may integrate with national and external third-party registries (e.g., the Estonian Transport Administration).<br data-start=\"10111\" data-end=\"10114\" \/>The Service Provider is not responsible for the accuracy or availability of such data.<br data-start=\"10200\" data-end=\"10203\" \/>The User is responsible for the lawful use of any data obtained through APIs.<\/p>\n<h4 data-start=\"10289\" data-end=\"10320\"><strong data-start=\"10294\" data-end=\"10320\">14. Security Reporting<\/strong><\/h4>\n<p data-start=\"10322\" data-end=\"10494\">Upon discovering a security vulnerability, the User must refrain from exploiting it and immediately notify via <a href=\"https:\/\/1auto.ee\/en\/contact\/\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;\">contact form<\/span><\/a>, following responsible disclosure principles.<\/p>\n<h4 data-start=\"10501\" data-end=\"10546\"><strong data-start=\"10506\" data-end=\"10546\">15. Sanctions and Prohibited Persons<\/strong><\/h4>\n<p data-start=\"10548\" data-end=\"10690\">The service may not be used by individuals or companies subject to international sanctions or restrictions under Estonian or EU legislation.<\/p>\n<h4 data-start=\"10697\" data-end=\"10735\"><strong data-start=\"10702\" data-end=\"10735\">16. Notices and Communication<\/strong><\/h4>\n<p data-start=\"10737\" data-end=\"10896\">Contractual notices are sent via email to the address associated with the User\u2019s account and are deemed received on the next business day following dispatch.<\/p>\n<h4 data-start=\"10903\" data-end=\"10960\"><strong data-start=\"10908\" data-end=\"10960\">17.
