1. Introduction

These Terms of Service (hereinafter referred to as the “Terms”) govern the use of the website https://1auto.ee and all of its subpages (hereinafter referred to as the “Website”).
The Website is operated by MARBELAUTO OÜ, registration code 17312034, Republic of Estonia (hereinafter referred to as the “Service Provider”).

By using the Website (including creating an account, publishing listings, browsing, or using other services), you confirm that you have read and agree to these Terms.
If you do not agree to the Terms, you are not permitted to use the Website.

2. Definitions

2.1. User – a natural person (consumer) or a legal entity (business client) and their authorized representatives who use the Website.
2.2. Listing – an announcement published on the Website by a Business Client offering a vehicle for sale, exchange, or promotion.
2.3. Content – all texts, photos, videos, logos, and data uploaded by the User.
2.4. Packages/Services – free or paid features provided by the Service Provider.

3. Service

3.1. Nature of the Service. The Service Provider offers a platform for publishing vehicle sales listings, tracking statistics, browsing listings, and comparing them.

3.2. Paid Services. Paid packages and additional services are intended for business clients (B2B) and may only be used on behalf of a legal entity.
Natural persons may only access free features (including browsing, comparing listings, and adding to favorites).

3.3. Account and Representation.
When creating an account, the User must provide accurate and complete information.
A Business Client confirms that they are acting with the proper authorization.
The User is responsible for all actions performed under their account.

3.4. Transactions.
All transactions (sale, purchase, exchange, etc.) take place directly between Users outside the Website.
The Service Provider is not a party to any transaction and bears no responsibility for the performance of agreements.

3.5. Service Modifications and Maintenance.
The Service Provider may improve, modify, or suspend core functionalities of the service.
Users will be reasonably notified of any material changes.
During scheduled maintenance, the service may be temporarily unavailable.
Secondary functionalities may be changed or removed without prior notice.

4. Listing Requirements

4.1. The User is responsible for ensuring that all information provided in listings is accurate and up to date.

4.2. Listings must be clear, precise, and descriptive of the offered object. Misleading links, advertisements, or references to competitor websites are prohibited.

4.3. Only one listing may be published per object.

4.4. Images, videos, and other files attached to a listing must not contain third-party watermarks and must belong to the User or be used with proper authorization.

4.5. The Service Provider reserves the right to remove or suspend any listings that do not comply with these requirements without prior notice.

4.6. Offensive, discriminatory, illegal, or obscene content is strictly prohibited.

4.7. Intellectual property infringement (e.g., copying another user’s listings or photos) is forbidden.

4.8. Accuracy of Vehicle Information. The User confirms that:

• • the VIN, mileage, and other data stated in the listing are accurate to the best of their knowledge;
  • any major accident, damage, or repair history is disclosed;
  • the vehicle is not stolen or legally encumbered (leasing, pledge, seizure) or that such encumbrances are clearly disclosed;
  • the images, videos, and other files in the listing reflect the actual vehicle being offered.

5. User Rights and Obligations

5.1. Accurate and complete data must be provided when creating an account.
5.2. The User is responsible for the security of their account and login credentials.
5.3. Listings may only be published for objects the User has a legal right to sell.

5.4. The User is prohibited from using the Website in a manner that violates applicable laws or disrupts its normal operation, including:

• • distributing malware, viruses, or other harmful code;
  • collecting or processing data (including information about other users) without consent;
  • using automated queries, bots, scripts, or scraping tools;
  • bypassing or attempting to circumvent security measures or reverse-engineering the platform;
  • creating or distributing spam listings or other unwanted content;
  • overloading the system or otherwise disrupting the Website’s normal functioning.

5.5. The User is liable for their actions and must compensate the Service Provider for any damages arising from a breach of the Terms.

5.6. The User must pay for all paid services according to the price list and agreed terms.

6. Fees, Billing, and Refunds

6.1. Publishing listings and using certain additional services is subject to a fee, available only to business clients, according to the price list.
6.2. Payments for services are made via secure payment methods (invoice, bank transfer, etc.).
6.3. Packages are prepaid monthly or annually and renew automatically unless the User notifies the Service Provider of termination.
6.4. Cancellations take effect at the end of the current period; payments already made are non-refundable unless otherwise agreed.
6.5. The Service Provider may amend the price list by notifying the User at least 30 calendar days prior to the effective date.
6.6. Statutory interest and possible collection or court costs apply to overdue payments.
6.7. Services are digital and available for immediate use; payments are non-refundable except when the Service was unavailable due to the Service Provider’s fault, in which case proportional credit will be granted.

7. Intellectual Property and Data Usage

7.1. All design elements, software, trademarks, databases, and content of the Website are owned by MARBELAUTO OÜ or its partners.
7.2. The User may not copy, distribute, sell, lease, reprogram, or translate any Website content into other languages without written permission.
7.3. By submitting a listing, the User grants the Service Provider a worldwide, non-exclusive, royalty-free, sublicensable, and transferable simple license to use the listing and related data (including images, texts, and technical specifications) for service delivery, promotion, and creation of anonymized statistics.
7.4. The license remains valid while the listing is active and for a reasonable archiving period thereafter.

8. Liability and Warranties

8.1. The service is provided on an “as-is” basis.
8.2. The Service Provider does not guarantee uninterrupted or error-free operation.
8.3. The Service Provider is not responsible for the content of listings, quality, or legality of the offered vehicles.
8.4. The Service Provider is not liable for technical failures, viruses, data loss, or actions of third parties.
8.5. The User is liable for damages resulting from violation of the Terms.
8.6. The Service Provider’s total liability shall not exceed the amount paid by the User during the three (3) months preceding the claim.
8.7. The Service Provider shall not be liable for indirect damages, lost profits, reputational harm, or data loss.

9. Validity and Termination

9.1. These Terms are valid indefinitely.
9.2. The Service Provider may suspend or terminate a User’s account in case of breach of the Terms or payment default.
9.3. The User may close their account at any time; paid fees are non-refundable.
9.4. The Service Provider may amend the Terms at any time by publishing the new version on the Website.
9.5. The Service Provider may terminate the service for technical, legal, or business reasons.
9.6. Neither party shall be liable for non-performance caused by force majeure (e.g., major communication or power outages, natural disasters, acts of war, etc.).

10. Data Protection and Privacy

10.1. Personal data is processed in accordance with the Privacy Policy and Cookie Policy.
10.2. MARBELAUTO OÜ processes data in compliance with applicable laws, ensuring data security and confidentiality.
10.3. System logs are retained for a reasonable period for security and auditing purposes.
10.4. The User has the right to access, correct, or delete their personal data as permitted by law.

11. Complaints and Dispute Resolution

11.1. Complaints may be submitted via the contact form. The Service Provider will respond as soon as possible, no later than within five (5) business days.
11.2. Disputes shall be resolved primarily through negotiations.
11.3. If no agreement is reached, disputes shall be settled in the Tartu County Court, Republic of Estonia, under Estonian law.
11.4. If the User is a natural person and the dispute concerns free services, the User may use legal remedies provided by law (including contacting the Consumer Disputes Committee).
Paid services are B2B, and consumer dispute procedures do not apply.

12. Indemnification

The User shall indemnify the Service Provider against all claims, damages, and costs (including reasonable legal fees) arising from the User’s actions, uploaded content, or breach of these Terms.

13. Third-Party Data Sources and API Usage

The Service Provider may integrate with national and external third-party registries (e.g., the Estonian Transport Administration).
The Service Provider is not responsible for the accuracy or availability of such data.
The User is responsible for the lawful use of any data obtained through APIs.

14. Security Reporting

Upon discovering a security vulnerability, the User must refrain from exploiting it and immediately notify via contact form, following responsible disclosure principles.

15. Sanctions and Prohibited Persons

The service may not be used by individuals or companies subject to international sanctions or restrictions under Estonian or EU legislation.

16. Notices and Communication

Contractual notices are sent via email to the address associated with the User’s account and are deemed received on the next business day following dispatch.

17. Language, Severability, and Entire Agreement

17.1. These Terms may exist in multiple languages; in the event of discrepancies, the Estonian version shall prevail.
17.2. If any provision is found invalid, the remaining provisions shall remain in full force and effect.
17.3. These Terms constitute the entire agreement between the User and MARBELAUTO OÜ.
A waiver of rights is not retroactive and does not limit their future exercise.
